1. How the Price Beat Guarantee Works

To request a Price Beat review, the customer must provide Hazmat Detection & Removal with a complete copy of the competing written quotation before accepting, paying a deposit to, or authorising the competing provider to commence the relevant works.

We will review the competing quotation and compare it with our proposed scope of works.

Where the competing quotation is genuinely comparable and satisfies these Terms & Conditions, Hazmat Detection & Removal will offer a revised price calculated at 5% below the comparable competitor price.

The revised price must be confirmed by Hazmat Detection & Removal in writing before it becomes an offer or forms part of any contract.

A customer does not receive an automatic 5% discount merely by providing a competing quotation.

2. The Competing Quote Must Be Genuine

The competing quotation must be a genuine written quotation issued by an identifiable Australian business, clearly identify the business providing the quotation, include sufficient information for a reasonable comparison to be made, be current and still valid for acceptance, relate to the same property, site or project, relate to substantially the same works, be capable of being accepted on the quoted terms, and not be a fabricated, altered, misleading or otherwise invalid quotation.

Hazmat Detection & Removal may request reasonable additional information from the customer or competing provider where necessary to verify the quotation or establish whether it is genuinely comparable.

3. Comparable Scope of Works

The Price Beat Guarantee applies only where the competing quotation provides the same or substantially comparable scope of works. The comparison may take into account labour, materials, equipment, plant and machinery, personal protective equipment, site preparation, containment, access requirements, height or difficult-access requirements, removal methodology, transport, waste removal, waste disposal, testing, inspection, air monitoring where applicable, clearance requirements, clearance certificates where applicable, reports and documentation, regulatory and safety requirements, mobilisation and demobilisation, travel or other applicable charges, GST, and any other material component of the proposed works.

A lower headline price does not necessarily constitute a comparable quotation.

4. Excluded or Incomplete Competitor Quotes

A competing quotation may not qualify where it excludes, omits or fails to clearly identify costs or works that are included in the Hazmat Detection & Removal quotation. This may include, without limitation: asbestos waste disposal, transport and disposal fees, required testing, air monitoring, clearance inspections, clearance certificates, required documentation, site preparation, containment, decontamination, access equipment, scaffolding, elevated work requirements, special equipment, additional labour, required safety controls, regulatory requirements, and any other work reasonably required to complete the agreed scope safely and lawfully.

If our quotation includes an item that the competing quotation does not include, the quotations may not be considered comparable.

5. Different Site Conditions or Assumptions

The Price Beat Guarantee does not apply where the competing quotation is based on materially different site conditions, access conditions, measurements, quantities, material assumptions, removal assumptions, working hours, site restrictions, safety requirements, disposal requirements, testing requirements, or scope assumptions.

If the competing quotation is based on assumptions that materially differ from those used in our quotation, we may adjust the comparison to establish whether the quotations are genuinely comparable.

6. Licensing, Qualifications and Regulatory Requirements

Where a licence, qualification, accreditation, notification, supervision or other regulatory requirement applies to the relevant work, the competing provider must be appropriately qualified and/or licensed as required by law.

A quotation from a provider who is not legally permitted to perform the relevant work will not be treated as a comparable quotation.

The Price Beat Guarantee does not require Hazmat Detection & Removal to match a price that appears to depend upon non-compliance with applicable legislation, safety requirements, licensing requirements or regulatory obligations.

7. Quotes That Do Not Qualify

The Price Beat Guarantee does not apply to quotations that are expired, withdrawn, no longer available for acceptance, contain obvious errors or omissions, are incomplete, are conditional upon additional purchases or services, exclude material components of the work, are based on materially different quantities or measurements, are based on materially different site conditions, include substantially different payment or contractual conditions, are promotional or temporary prices not generally available, include rebates or discounts that cannot reasonably be replicated, are introductory or loss-leader prices not generally available, are from a related company where the quotation is not a genuine independent commercial comparison, are not genuine commercial quotations, appear to have been created or altered solely for the purpose of obtaining a lower price, cannot reasonably be verified where verification is reasonably required, or would require Hazmat Detection & Removal to omit legally required, safety-critical or reasonably necessary works.

8. GST and Total Price Comparison

The comparison will be made on a like-for-like basis. Where GST is applicable, the competing price and our price will be compared on the same GST-inclusive basis.

Any unavoidable or mandatory costs included in one quotation but excluded from the other may be taken into account when determining whether the quotations are genuinely comparable.

9. No Reduction in Scope

The Price Beat Guarantee is intended to provide customers with a lower price for comparable work, not a lower price achieved by reducing the required scope or standard of service.

10. Verification of Competing Quotations

Hazmat Detection & Removal reserves the right to reasonably verify the authenticity and material terms of a competing quotation. Where reasonably necessary, we may request clarification or confirmation from the customer and/or the competing provider.

We will not disclose unnecessary personal information to a competing provider. The customer is responsible for ensuring that they are entitled to provide the competing quotation to us.

11. Customer Responsibility

The customer is responsible for providing complete and accurate information regarding the competing quotation. The customer must not alter the competing quotation, remove pages or material information, misrepresent the competitor's scope or price, provide a quotation that is not genuine, or withhold material conditions that affect the comparison.

If material information has been withheld or misrepresented, the Price Beat Guarantee may be withdrawn or not applied.

12. No Automatic Entitlement

Submission of a competing quotation does not automatically entitle the customer to a 5% reduction. The Price Beat Guarantee only applies where Hazmat Detection & Removal determines, acting reasonably and based on the information available, that the competing quotation satisfies these Terms & Conditions and is genuinely comparable.

Any Price Beat offer must be confirmed by Hazmat Detection & Removal in writing.

13. Final Price

Where the competing quotation qualifies, the Price Beat price will be calculated as: comparable competitor price less 5% = Price Beat price.

The resulting price will apply only to the comparable scope of works identified during the review. Any additional works, variations, unforeseen site conditions or changes to the agreed scope will be dealt with separately in accordance with the applicable quotation and contract.

14. Unforeseen Conditions

The Price Beat Guarantee does not require Hazmat Detection & Removal to absorb costs arising from conditions that were not reasonably identifiable or allowed for when the quotation was prepared. Where unforeseen conditions require additional work, the additional work may be quoted separately, subject to applicable law and the terms of the relevant contract.

15. Availability of the Guarantee

The Price Beat Guarantee is a voluntary promotional offer provided by Hazmat Detection & Removal. Hazmat Detection & Removal may amend, suspend or withdraw the Price Beat Guarantee for future quotations at any time.

However, any Price Beat offer already confirmed in writing to a customer will be dealt with in accordance with the terms of that confirmed offer, subject to applicable law.

16. No Transfer or Cash Alternative

The Price Beat Guarantee is not transferable, cannot be exchanged for cash, cannot be applied retrospectively to completed works, cannot be claimed after another provider has been accepted or authorised to commence the relevant works, and cannot be combined with another discount or promotional offer unless expressly approved by Hazmat Detection & Removal in writing.

17. Quotation Expiry

Any revised quotation issued under the Price Beat Guarantee remains subject to the validity period stated on the revised quotation. The Price Beat Guarantee does not extend or renew the validity period of a quotation unless expressly confirmed in writing.

18. No Hidden Reduction in Scope

A Price Beat quotation will continue to reflect the agreed scope of works and the requirements reasonably necessary to perform those works safely and lawfully. The customer should compare the complete scope, not merely the headline price.

19. Acceptance of the Revised Quotation

A Price Beat price is not binding until Hazmat Detection & Removal has issued the revised quotation in writing. The customer may accept or decline the revised quotation. Acceptance of the revised quotation will be subject to the applicable quotation, service terms and any other contractual documents provided by Hazmat Detection & Removal.

20. Consumer Law

Nothing in these Price Beat Guarantee Terms & Conditions is intended to exclude, restrict, modify or limit any rights or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable legislation.

Where a consumer guarantee or other mandatory legal right applies, that right continues to apply regardless of these Terms & Conditions.

21. Interpretation

These Terms & Conditions are intended to ensure that competing quotations are compared fairly and on a genuinely like-for-like basis. Where there is uncertainty about whether two quotations are comparable, Hazmat Detection & Removal may request further information before determining whether the Price Beat Guarantee applies.

The Price Beat Guarantee is not intended to encourage customers to select a provider based solely on price where doing so would compromise required safety, regulatory compliance, qualifications, licensing, disposal, testing or documentation.

22. Changes to These Terms

Hazmat Detection & Removal may update these Price Beat Guarantee Terms & Conditions from time to time. The version applicable to a Price Beat request will generally be the version published at the time the request is made, unless a different version has already been expressly incorporated into a written offer made to the customer.
